Juggle Street General Liability Insurance Exclusions List
Exclusions – please note this is a summary of the Exclusions in the Juggle Street General Liability Policy only. Nothing contained here is intended for general or personal advice. Nothing contained in this summary should be understood to be an express or implied condition, term or exclusion which forms part of the Insurer terms and conditions or be relied upon in the event of a claim.
- Advertising Injury – including an incorrect description of the price of equipment, and the failure of equipment to conform with advertised performance, quality or fitness for purpose.
- Aggravated, punitive or exemplary damages - including fines, penalties and liquidated damages.
- Aircraft and Watercraft – any liability involving aircraft or watercraft, including equipment which forms part of the structure of aircraft and watercraft.
- Asbestos –any liability directly or indirectly arising out of, resulting from, in consequence of, contributed to or aggravated by asbestos in whatever form or quantity.
- Contractual Liability – any liability assumed by you under a contract in connection with the equipment.
- Electronic Data – including communications, online displays or publications or any distribution via electronic means. Also including any error in using electronic information and communication.
- Employers’ Liability – including Workers’ Compensation claims and your liability as an Employer under any industrial award.
- Loss of Use – third party property must be damaged or destroyed for cover to apply. Where loss is caused only by a delay in providing equipment, or the failure of equipment to be fit for purpose, this will not be covered.
- Nuclear – liability directly or indirectly arising from ionising radiation or radioactivity contamination.
- Products and Work Performed – including any refund for faulty equipment.
- Your Property – liability for Property Damage to property owned by or in the care, custody or control of any Insured.
- Professional Liability – including any professional advice given for a fee.
- Failure to Insure Property – including any property damage to any equipment leased or rented to you when you are required to insure it.
- The Insurer will not be liable to provide any cover, pay any claim or provide any benefit under this Policy, to the extent that to do so may expose the Insurer to any sanction, prohibition, or restriction under United Nations resolutions or any applicable trade or economic sanctions, laws or regulations of any country.
- Sexual Abuse/ Sexual Assault/ Molestation – liability arising directly or indirectly from, contributed to or in connection with sexual assault, sexual abuse or attempt thereat. Also excludes Defence Costs and Supplementary Payments in relation to sexual assault, sexual abuse, molestation or attempt thereat.
- Terrorism – any liability arising directly or indirectly from an Act of Terrorism.
- Underground Services – before performing any underground work, the relevant authorities must provide details of the exact position of all cables, pipes and other underground facilities, otherwise there will be no cover.
- Vehicles – no cover where the damage arises from vehicles which are required to be registered.
- War – no cover where the damage is a consequence of war.
